Tax Offer in Compromise - The Basics

An offer in compromise (OIC) must be equal to, or greater than, your reasonable ability to pay the amount you owe. The term used by the IRS is reasonable collection potential (RCP). The RCP is defined by the IRS as the total of the taxpayer's realizable value in real and personal assets, plus future income.

The IRS may legally negotiate an offer in compromise tax settlement for several specific reasons.

  • When there is doubt as to the taxpayer's liability.
  • When doubt exists that the assessed tax is correct.
  • When there is doubt as to whether the taxpayer's debt is collectible.
  • When doubt exists that the taxpayer could ever pay the full amount of tax owed.
  • For the purpose of effective tax administration.

If none of these criteria fit your situation and you have the ability to pay the tax liability in a lump sum or through an installment agreement, you will not be eligible for an offer in compromise.
