IRS Wage Garnishments and Levy - The Basics
If you have received a Notice and Demand for Payment from the IRS it is important to contact us immediately. You only have 30 days to request a hearing with an IRS manager. At this hearing, we can typically have a levy or wage garnishment released if:
- The tax debt owed was paid before the Notice and Demand of Payment or levy notice was sent.
- The time legally available to collect the tax expired.
- Release of the tax levy would allow for the tax debt to be collected.
- An installment loan agreement or offer in compromise has been established or is in the process of being worked out.
- An Innocent Spouse defense is being made.
- The tax levy was made while the taxpayer was in bankruptcy.
- The fair market value of the levied property exceeds the liability.
While the IRS can levy most of your assets including your wages, home, retirement accounts, dividends, bank accounts, rental income, the cash loan value of your life insurance, and commissions, there are some limitations. Some of your assets that cannot be levied include clothes, school books, unemployment benefits, some annuity and pension payments, workers' compensation benefits, judgments for support of minor children, and a certain amount of books and tools of a trade, business, or profession.
